About Sara’s Practice
After completing her undergraduate degree from Wake Forrest University, Sara Clay attended law school at University of Georgia where she received her law degree in 1990. In 1996 she married her husband, Chuck Clay. Together, they reside in Marietta, Georgia, and have five children.
Sara M. Clay has been a practicing attorney for over 20 years and a specialist in A.R.T. and Surrogacy Law for over 7. Since assuming her current practice in 2003, Sara has become one of the nation’s foremost surrogacy attorneys, representing those in need of legal counsel regarding issues concerning surrogate parenthood and other forms of assisted reproduction. Today, she devotes her professional time and talents to advocating for the legal rights of intended parents seeking to have children via alternative reproductive methods.
Sara’s husband Chuck is also a part of the Professional Group of Infertility Specialists and serves as the organization’s lobbyist, working to prevent legislation which could potentially have a negative impact on the rights and needs of infertility patients.
Who Sara Represents:
Sara’s practice is devoted to representing the legal interests of intended parents who want to begin or expand their families through surrogacy / assisted reproductive technology. While she enthusiastically works with parents who approach her directly, the majority of Sara’s clients come to her via referrals from physicians, hospitals/clinics, and medical organizations. Sara is currently contracted by the Center for Surrogate Parenting (CSP) to oversee and review surrogate cases on behalf of the organization in states located along the Atlantic Coast. Her practice is regularly referred to intended parents by such noted entities as the Atlanta Center for Reproductive Medicine, Georgia Reproductive Specialists, Reproductive Biology Associates, Emory University, Gyn Fertility Specialistsand the American Society of Reproductive Medicine (ASRM). Sara’s clients include heterosexual couples, same-sex couples, and individuals pursuing parenthood.
Reaching beyond Georgia, Sara’s practice represents clients from all corners of the world. Although surrogates involved in any arrangement must be a resident of Georgia, Sara’s clientele of intended parents includes residents of Israel, Norway, China, Japan, Australia, France, Switzerland and the United States.
Sara M. Clay’s Legal Services:
The legal process involved in pursuing surrogacy can initially seem overwhelming to those considering alternative methods of having a baby. Both as a parent and as an experienced surrogate attorney, Sara Clay understands the emotions, fears, frustrations, and financial demands that accompany a decision to pursue assisted reproductive methods. Her practice is geared towards offering a hands-on, supportive approach aimed at meeting her clients’ emotional as well as legal needs. In addition to simplifying the process for her clients, Sara also seeks to relieve intended parents’ fears and concerns by remaining accessible and eager to listen and answer any and all questions her clients may have.
Legal services include:
- Negotiating and Drafting Surrogacy Arrangements
- Representation in Required Court Proceedings
- Assistance in recommending medical professionals and organizations that can help intended parents interested in pursuing surrogacy
- Assistance in locating prospective surrogates
- Assistance in obtaining a Medical Affidavit (necessary to establish the intended parents as the legal parents)
- Other services required and/or related to facilitating a legal surrogate agreement
Note: Most fertility clinics will not conduct assisted reproduction procedures without a formal legal contract first being in place. Any surrogate agreement not properly drawn up by a licensed attorney could be deemed by the court to be null and void and could allow the surrogate parent to maintain a legal right to custody of the child.
Note: It is a felony for anyone other than a medical doctor to artificially inseminate a surrogate.
